Arkansas Dry Counties, Private Club Permits and Alcohol Licenses: Wet and Dry Map, $1,500 Club Permit, June 30 Expiry and Act 762
Arkansas Dry Counties, Private Club Permits and Alcohol Licenses: Wet and Dry Map, $1,500 Club Permit, June 30 Expiry and Act 762
Informational only: This guide explains how Arkansas alcohol rules generally work. It is not legal or tax advice. Alcohol rules are local and can change, so confirm every fee and deadline with the named agency before you commit money. For complex situations, talk with a qualified Arkansas attorney or CPA.
Before you shop for an arkansas liquor license, answer one question: is your address in a wet area, a dry area, or a split zone? Arkansas alcohol status is set by local option, and that answer determines which route you can take. Where sales are authorized, you pursue the alcohol permit that fits your business. Where the area is dry, the usual route is a private club permit, and that is where many new operators get stuck. This guide covers the wet and dry map, the $1,500 club permit, the June 30 expiration, and what Act 762 of 2025 changed.
How Arkansas Local Option Works
Arkansas has 75 counties and roughly 500 municipalities. Alcohol status is decided locally. Counties, and the townships or cities inside them, can each be wet or dry. That means one county can be split: the county may be dry while a city inside it is wet, or the reverse. Do not assume a county's status applies to your street address.
No official statewide count of dry counties is published. The Alcoholic Beverage Control Division (ABC) publishes a wet and dry map, and its GIS data layer, read in October 2026, showed about 29 counties dry countywide. Treat that figure as approximate. The county clerk holds the official record for each area, so when the map and a clerk's record appear to disagree, get the clerk's answer in writing.
Step 1: Confirm Whether Your Location Is Wet, Dry or Split
- Open the ABC wet and dry map and locate your exact address, not just your county.
- Check whether your city or township has a different status from the surrounding county.
- Contact the county clerk for the official record covering that address.
- Save the clerk's record with your permit file so you can show it later.
Private Club Permits in Dry Areas
In a dry area, a private club permit lets you serve beer, wine and spirits. Hotel, restaurant and large-event private club permits carry these costs:
| Permit | Annual cost | Notes |
|---|---|---|
| Hotel, restaurant or large-event private club permit | $1,500 a year to apply and renew | Plus an extra $1,500 application fee where liquor sales are not authorized by local option |
| Large-event facility permit | $2,500 a year | Confirm eligibility and fees with ABC |
Using these figures, a new applicant in a dry area with no local option authorization should expect a first-year total of $3,000 for the club permit itself: the $1,500 application and renewal amount plus the $1,500 extra application fee. City fees, sales tax permits and other costs come on top. Confirm the full first-year amount with ABC before you sign a lease or order equipment.
Act 762 of 2025 Changed Who Can Hold the Permit
Act 762 of 2025, effective August 5, 2025, removed the nonprofit requirement. A for-profit corporation, LLC, partnership or sole proprietor can now hold a private club permit. If an older article tells you that a club must be a nonprofit, it is out of date on this point. Choose your ownership structure based on liability, taxes and how you plan to raise money, and get advice on that choice from a qualified professional.
Permit Holder Requirements
The owner or manager who holds the permit must live in Arkansas and must live either in the business's county or within 35 miles of it. Applicants also attend the ABC seminar, which is held on the first Friday of each month. Build the seminar date into your timeline before you file, because it can take a few weeks to fit your schedule around a monthly session.
June 30 Expiration and Late Renewal Penalties
All ABC permits expire June 30. Renewing on time avoids penalties, and the penalty grows the longer you wait:
| Renewal window | Amount added to the permit price |
|---|---|
| July 1 to August 29 | Half the permit price (on a $1,500 permit, $750) |
| August 30 to October 28 | The full permit price (on a $1,500 permit, $1,500) |
On a $1,500 club permit, a renewal paid in mid-July would total $2,250, and one paid in September would total $3,000, before any other charges. Confirm this math with ABC before you pay, and ask what applies after October 28, because this guide does not cover that period.
The 1,000 Foot Distance Rule Applies Only to Retail Liquor Stores
Only retail liquor stores must be 1,000 feet from schools and churches. Do not apply that rule to a private club permit by default. If a school or church is nearby, ask ABC how distance matters for your specific permit type before you make any commitment.
Registration Steps Around the Permit
Arkansas has no general state business license and no county business license. The state registers businesses by activity, and the ABC permit is one piece of that. Most club operators will also need the following:
- Entity formation. An LLC files the Certificate of Organization (Form LL-01) with the Secretary of State for a $45 filing fee online ($50 on paper). The Secretary of State lists 3 to 5 business days of processing for filings that are mailed, dropped off or submitted online, and it does not publish an expedited service. In-person drop offs carry a 48-hour turnaround under the Business Services FAQ. File through the Corporations Online Filing System, and check your name in the Secretary of State business search first.
- Registered agent. Arkansas uses the term registered agent. Every registered entity must keep one with a street address in Arkansas where the agent is located. A P.O. Box is not acceptable, and an incomplete filing will be returned. The agent can be an individual or a commercial registered agent.
- Annual franchise tax report. An LLC pays a flat $150 annual franchise tax with the Annual LLC Franchise Tax Report, due May 1. Late filing adds a $25 penalty plus interest.
- Sales and use tax permit. Any business selling taxable goods or services needs a sales and use tax permit from the Department of Finance and Administration. The permit costs $50 and is applied for through the Arkansas Taxpayer Access Point. The state sales tax rate is 6.5 percent. Confirm which of your sales are taxable with the Department of Finance and Administration or a CPA.
- Unemployment insurance. Register with the Division of Reemployment for unemployment insurance once you plan to have employees. Confirm the timing with the division.
- Food service. If your club serves food, the Department of Health licenses food establishments. Confirm what your operation requires with the Department of Health before you open.
- City license. Cities set their own rules, and no statewide list is published here. Little Rock and North Little Rock charge a base plus a per-employee amount, Bentonville runs a free registry, and Conway imposes none. Check your city's current requirements, because a city license is separate from the ABC permit.
What to Confirm With Each Agency
- ABC: current permit fees, the late renewal math after October 28, the seminar schedule, eligibility for your location, and the wet or dry status of your address.
- County clerk: the official local option record for your property, and the assumed name filing if you operate as a sole proprietor.
- City or township: whether a local license, privilege license or registry applies to you.
- Department of Health: food establishment licensing for your menu and kitchen.

A Practical Order of Operations
- Confirm your exact address is wet, dry or split, and save the clerk's record.
- Choose your entity type. Under Act 762, a for-profit structure can hold the permit.
- Form the entity and appoint a registered agent with an Arkansas street address.
- Attend the ABC seminar on a first Friday and confirm the permit holder meets the residency and distance rules.
- Register for sales tax, unemployment insurance and any city license that applies.
- Calendar June 30 and the May 1 franchise tax deadline, and renew early to avoid the July 1 penalty.
When to Get Professional Help
A dry-area club with outside investors, multiple owners, a managed property or a lease with a liquor clause involves decisions that a template cannot settle. A qualified Arkansas attorney should review the entity structure, permit holder arrangement and lease terms. A CPA should advise on how club receipts and the franchise tax are treated for your situation.
